Eleva Beyond Terms and Conditions

1. General

1.1. Welcome to Eleva Beyond’s Terms and Conditions ("Terms and Conditions" or “Terms”) page.

1.2. Eleva Beyond, as well as the Services (as defined below), are provided by Dragonpass International Limited, located at 4th Floor, Charter House, 2 Woodlands Road, Altrincham, WA14 1HF, United Kingdom, and its affiliated companies (“Dragonpass”).

1.3. When you read these Terms and Conditions, please note that the terms “you”, “your” and “User(s)” refer to the person(s) in whose name the Eleva Beyond Membership is registered. The terms “we”, “our”, “us”, “Eleva Beyond” and “Dragonpass” refer to Dragonpass International Limited and its affiliates, successors and assigns. If you have successfully registered an Eleva Beyond Membership with us, you will be known as the “Eleva Beyond Member” and you will have an account with us called the “Eleva Beyond Membership”.

1.4. By using Eleva Beyond and our related Services, you are agreeing to these Terms and Conditions, as well as our Privacy Notice (accessible at www.elevabeyond.com) and Terms of Use (accessible at www.elevabeyond.com), all of which will constitute a binding agreement between Dragonpass and you when you use Eleva Beyond and any of our related Services. Accordingly, please review the above documents before using Eleva Beyond and any of our related Services, and in the event that you do not agree with any provision(s) contained therein, please do not use (or please discontinue to use, as the case may be) Eleva Beyond and our related Services. Take note however that in such an event, no refund of any kind will be provided to you.

2. Definitions

2.1. In these Terms and Conditions:

2.1.1. “Dining Discount(s)” means certain discounts, offers and privileges offered at Dragonpass Participating Outlets for food and beverages for Eleva Beyond Members.

2.1.2. “Dining Voucher(s)” refers to a digital certificate or voucher with customized face-value, which can be used to pay for or offset the total amount incurred by an Eleva Beyond Member when purchasing certain Dining Services at Dragonpass Participating Outlets, subject to the use of only 1 (one) Dining Voucher per purchase. For the avoidance of doubt, Dining Vouchers are not legal tender and cannot in any way be exchanged for cash or cash equivalent.

2.1.3. “Dragonpass Technical Solutions” means the various technical solutions of Dragonpass (including but not limited to API and HTML5), through which Eleva Beyond Members may access the Services via a Provider.

2.1.4. “Dragonpass Participating Outlets” refers to third party service and facility providers (including without limitation, airport lounges, fast track, dining, retail, fitness, limousine, e-SIM, flight booking, and hotel booking Service providers, as well as any other Service providers that may be added in future) participating in and providing their services and products thereunder the Services. For the avoidance of doubt, Dragonpass Participating Outlets are not subcontractors, agents or representatives of Dragonpass, nor are they under the supervision or control of Dragonpass, and as such you agree that Dragonpass bears no responsibility or liability for the acts or omissions or the quality (or any other aspect) of the services or products of Dragonpass Participating Outlets.

2.1.5. “Eleva Beyond App” means the official mobile applicable of Eleva Beyond.

2.1.6. “Eleva Beyond Membership” means the membership issued by us pursuant to these Terms and Conditions, including any substitution, replacement or renewal thereof.

2.1.7. “Eleva Beyond Website” means the official Eleva Beyond website (www.elevabeyond.com).

2.1.8. “e-SIM Service” or “e-SIM” means the e-SIM services offered and/or available to Eleva Beyond Members by Dragonpass, as supplied by its third-party provider, eSIM Go Limited, with registration number 12465777 and registered address situated at 8 North Bar Street, Banbury, Oxfordshire, OX16 0TB.

2.1.9. “Fast Track Service” or “Fast Track” means the fast track services which are offered and/or available to Eleva Beyond Members at Dragonpass Participating Outlets at airports and railway stations, which includes (but is not limited to) airport security fast track and passport control fast track lanes.

2.1.10. “Fitness Service” or “Fitness” means the fitness services offered and/or available to Eleva Beyond Members at Dragonpass Participating Outlets which includes, but is not limited to, gym classes and single-use day passes.

2.1.11. “Flight Booking Service” or “Flight Booking” means the flight booking services offered and/or available to Eleva Beyond Members which enables you to seamlessly book flights via our third-party partner, Travelfusion Asia Pte Limited, with registration number UEN 202549671N and registered address situated at 16 New Industrial Road, #04-02, Hudson Technocentre, 536204, Singapore.

2.1.12. “Hotel Booking Service” or “Hotel Booking” means the hotel booking services offered and/or available to Eleva Beyond Members which enables you to seamlessly make hotel reservations via our third-party partner, Agoda Company Pte Limited, with registration number UEN 200506877R and registered address situated at 36 Robinson Road, #20-01, City House, 068877, Singapore.

2.1.13. “Limousine Service” or “Limousine” means the limousine and/or transport services offered and/or available to Eleva Beyond Members by Dragonpass, as provided by Dragonpass Participating Outlets, including but not limited to airport transfers, chauffeur services, and other transport services.

2.1.14. “Lounge Service” or “Lounge” means the lounge services provided at Dragonpass Participating Outlets at airports and railway stations, which includes (but is not limited to) the supply of food and beverages, access to the internet, newspapers and magazines, and the usage of VIP rooms at said lounges, for Eleva Beyond Members.

2.1.15. “Multi-purpose Voucher” or “MPV” means a multi-purpose voucher that allows Eleva Beyond Members to redeem Lounge entitlements at selected Dining and Retail locations.

2.1.16. “Retail Discount(s)” means certain discounts, offers and privileges offered at Dragonpass Participating Outlets for retail services for Eleva Beyond Members, including but not limited to spa services.

2.1.17. “Retail Voucher(s)” refers to a digital certificate or voucher with customized face-value, which can be used to pay for or offset the total amount incurred by an Eleva Beyond Member when purchasing certain Retail Services at Dragonpass Participating Outlets, subject to the use of only 1 (one) Retail Voucher per purchase. For the avoidance of doubt, Retail Vouchers are not legal tender and cannot in any way be exchanged for cash or cash equivalent.

3. Dragonpass Services

3.1. Dragonpass may provide the following services ("Services") to Eleva Beyond Members, now or at any time in the future:

3.1.1. Dining Discounts and Promotions;

3.1.2. Dining Vouchers and Set Meals;

3.1.3. e-SIM;

3.1.4. Fast Track;

3.1.5. Fitness;

3.1.6. Flight Booking;

3.1.7. Hotel Booking;

3.1.8. Limousine;

3.1.9. Lounge;

3.1.10. Multi-purpose Vouchers;

3.1.11. Retail Discounts and Promotions; and

3.1.12. Retail Vouchers.

4. Registration of Eleva Beyond Membership

4.1. You are obliged to provide complete and truthful information at all times when registering for an Eleva Beyond Membership.

4.2. To register for Eleva Beyond Membership and access the Services, you need to be 18 (eighteen) years old or older, have the power to enter into a binding agreement with us, and not be barred from doing so under any applicable laws. You also warrant that any registration information that you submit to Dragonpass is true, accurate, and complete, and you agree to keep it that way at all times. Accordingly, in the event of any changes, you undertake to promptly update your registration and Eleva Beyond Membership information as soon as reasonably possible.

4.3. Dragonpass has the right to suspend or terminate your Eleva Beyond Membership at its sole discretion immediately with no refund (whether in whole or in part), no membership duration extension, and/or other compensation of any kind if information provided by you is considered by Dragonpass in its sole and reasonable discretion to be false, incorrect and/or incomplete.

4.4. You are solely responsible to maintain and protect your Eleva Beyond Membership information.

4.5. Dragonpass will not be held responsible if your Eleva Beyond Membership is terminated due to account information not being updated, or otherwise false, incorrect or incomplete.

4.6. You are not allowed to transfer your Eleva Beyond Membership before or after registration to any other persons.

4.7. Notwithstanding any other provisions in these Terms and Conditions, Dragonpass has no responsibility to verify whether any instructions, requests or transactions received by Dragonpass via your Eleva Beyond Membership are in actuality made or authorized by you, and therefore you undertake to remain fully liable for all acts, omissions and/or transactions made through your Eleva Beyond Membership.

4.8. You may at any time choose to delete your Eleva Beyond Membership in-app or via our website at www.elevabeyond.com, however, take note that after such deletion you will no longer be able to access any of our Services, we will not be able to fulfil any transactions that you have submitted to us (even if payment has already been made), and no refunds or other compensation of any kind will be provided to you.

5. Eleva Beyond Membership Validity Period

5.1. The first month of your Eleva Beyond Membership shall be provided free of charge, commencing on the date of your successful registration (“Registration Date”).

5.2. Following the expiry of the free 1 (one) month period, the applicable monthly membership fee shall become payable and will continue to be charged on a recurring monthly basis until your Eleva Beyond Membership is terminated in accordance with these Terms and Conditions.

5.3. By registering for Eleva Beyond Membership, you authorise Dragonpass to automatically charge the applicable monthly membership fee to the payment card or other payment method provided by you during registration. The membership fee will be debited on the monthly anniversary of your Registration Date (or, where applicable, the nearest practicable business day) for each successive monthly membership period, unless and until your Eleva Beyond Membership is terminated.

5.4. You are responsible for ensuring that your payment details remain valid and up to date. If a payment cannot be successfully processed, Dragonpass reserves the right to suspend or terminate your Eleva Beyond Membership until all outstanding amounts have been paid.

5.5. If you procured your Eleva Beyond Membership through a third party (your “Provider”) such as (but not limited to) a bank or issuer, as a benefit, the above may not be applicable to you. The validity of your Eleva Beyond Membership may vary depending on your Provider. Please check your Provider’s own terms and conditions in this regard.

6. FAIR USAGE

6.1. Responsible Use:

6.1.1. You agree to at all times use your Eleva Beyond Membership responsibly and in compliance with applicable laws and regulations. Unlawful, unethical, or irresponsible use of the Services is strictly prohibited.

6.2. Non-Abuse:

6.2.1. You shall not engage in any activities that may abuse or exploit the resources of Dragonpass. This includes, but is not limited to, any form of excessive usage that may impact the performance or availability of the Services for other Eleva Beyond Members.

6.3. Reasonable Limits:

6.3.1. While we strive to provide high-quality Services, you acknowledge and agree that Dragonpass may impose reasonable limitations on usage, including but not limited to bandwidth, storage, and other resources, to ensure fair and equal access to all Eleva Beyond Members.

6.4. Monitoring and Enforcement:

6.4.1. Dragonpass reserves the right to monitor the usage of its Services to ensure compliance with these Terms and Conditions. If, in its sole discretion, Dragonpass determines that an Eleva Beyond Member is in violation of this Fair Usage Clause, Dragonpass may take appropriate actions, including but not limited to warning, suspension, or termination of the Eleva Beyond Member’s Eleva Beyond Membership or access to the Services.

6.5. Communication:

6.5.1. Eleva Beyond Members engaging in activities that may be deemed excessive or abusive will be contacted by Dragonpass to discuss and resolve the issue. Eleva Beyond Members are encouraged to communicate with Dragonpass directly to address any concerns related to fair usage.

6.6. Updates to Fair Usage Policy:

6.6.1. Dragonpass reserves the right to update, modify, or revise this Fair Usage Clause at any time without notice. You agree that you are responsible for regularly checking these Terms and Conditions (which include this Fair Usage Clause) for any updates, and continued use of any of the Services after such updates have been published will constitute acceptance of the updated Terms and Conditions.

6.7.2. By using Eleva Beyond and our related Services, you acknowledge that you have read, understood, and agreed to abide by the Terms and Conditions outlined in this Fair Usage Clause.

7. Dragonpass Service Regulation

7.1. General

7.1.1. Eleva Beyond Membership is not transferable and is only valid up to its date of expiry. The Eleva Beyond Membership, and the Services thereunder, may not be used by any person other than the named Eleva Beyond Member.

7.1.2. All Eleva Beyond Memberships purchased from the Eleva Beyond Website, Eleva Beyond App, and/or related Dragonpass Technical Solution are non-refundable. Payment must be made online or when billed, which can be up to 6 (six) months after purchase (whether for Eleva Beyond Membership or any Services that are chargeable). For Eleva Beyond Memberships and Services or products thereunder that are purchased from other channels or Providers, such Services or products may be subject to such respective channel or Provider’s applicable terms and conditions.

7.1.3. You are required to sign at the back of your physical Eleva Beyond Membership card (If applicable).

7.1.4. All Services provided by Dragonpass under Eleva Beyond are at all times subject to these Terms and Conditions, our Terms of Use, and our Privacy Notice, as well as the applicable terms and conditions of the Dragonpass Participating Outlet in question, as may be amended from time to time without notice.

7.1.5. All Services and products (including any complimentary gifts) are provided solely by the Dragonpass Participating Outlets, under such terms and conditions as determined by such Dragonpass Participating Outlets, and accordingly Dragonpass makes no warranty or representation as to the quality, merchantability or fitness for purpose (even if advised in advance of such purpose) of such Services or products.

7.1.6. Dragonpass is not involved and does not participate in establishing the prices of the Services and products offered by Dragonpass Participating Outlets, or the actual Services and products described, nor does it have any responsibility regarding (but not limited to) any offers, entitlements, discounts, vouchers and/or privileges, nor the availability or unavailability of such products or Services for any reason.

7.1.7. Services are at all times subject to availability, and certain Services may be subject to eligibility requirements.

7.1.8. Dragonpass does not accept liability for any failure by us to perform our obligations hereunder these Terms and Conditions due to force majeure or any event beyond our reasonable control. A non-exhaustive list of such events includes war or threat of war, riots, civil strife, terrorist threats or activity, industrial disputes, natural and/or nuclear disaster, fire, adverse weather conditions, government regulations, crown instruction, closure, or congestion of airports, and/or cancellation or changes of schedules by airlines or railway operators.

7.1.9. In the event that you have booked a Service, please note that each Service or product operates independently of each other. Accordingly, when you book a Service, we and our Dragonpass Participating Outlets are only supplying you with the Services per se, and we and our Dragonpass Participating Outlets will not be responsible for any costs, compensation costs or expenses relating to any flights or other Services that you may have arranged. You are responsible for ensuring that you allow sufficient time for car parking, transfer to terminal, airport or railway procedures (including but not limited to checking-in and security) and any subsequent flight/travel arrangements. Neither Dragonpass nor the Dragonpass Participating Outlets shall be responsible for any Eleva Beyond Members who miss their flight or train because they did not allow sufficient time to go through the check-in and security process. All applicable security procedures, rules and regulations apply to their full extent, and such access will be governed strictly in accordance therewith.

7.1.10. You will be liable for any damage to the Dragonpass Participating Outlet, or its premises, caused by your actions while using the Service.

7.1.11. All rules relating to pre-booking, cancellation and refunds for the Services are dealt with in the specific Terms and Conditions applicable to each Service, as set out below.

7.1.12. Dragonpass Participating Outlets may be added or removed from the Dragonpass network from time to time in Dragonpass’s sole discretion without notice.

7.1.13. Dragonpass is not responsible for, nor does it provide a warranty as to, the goods and Services accessed through and provided by the Dragonpass Participating Outlets.

7.1.14. Dragonpass will not be liable for any misuse, damage, injury or death in relation to any Service, and any such instances will need to be raised directly with the relevant Dragonpass Participating Outlet.

7.1.15. Redemptions for Services will be applied against your entitlement count as displayed in the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution (if applicable).

7.1.16. The Dragonpass system allows for redemptions, and therefore the system will allow or disallow all redemptions based on fair usage and/or remaining entitlements available to you.

7.1.17. Dragonpass’ decision on all matters relating to the Services are final and binding and no further correspondence will be entertained in relation thereto.

7.1.18. Dragonpass reserves the right to amend, revoke, vary or add to the terms and conditions of any Service, or terminate any Service, or any of its governing terms, in its absolute discretion at any time without any liability.

7.2. Dining Discounts and Promotions

7.2.1. All Dining Discounts and Promotions are open to all Eleva Beyond Members unless otherwise stated.

7.2.2. To enjoy the Dining Discounts and Promotions, you are required to present your digital Dragonpass redemption page. A list of Dragonpass Participating Outlets is at all times available on the Eleva Beyond App, Eleva Beyond Website or related Dragonpass Technical Solution (as applicable).

7.2.3. All Dining Discounts and Promotions are subject to availability and a while-stocks-last basis.

7.2.4. All Dining Discounts and Promotions listed may be subject to prevailing government taxes and service charges, where applicable.

7.2.5. All Dining Discounts and Promotions are not exchangeable for cash, credit or other goods and services and are non-transferable.

7.2.6. You are required to present your digital Dragonpass redemption page prior to ordering or payment for the Service.

7.2.7. All complimentary gifts or items (if any) are provided on a while-stocks-last basis and are not refundable or exchangeable for cash, credit or other items of any kind and are not transferable.

7.2.8. Dragonpass and its Dragonpass Participating Outlets reserve the right to replace any complimentary gift or item (with an item of similar value) if it is unavailable at the time of purchase/confirmation of order, where applicable, without prior notice to Eleva Beyond Members.

7.2.9. All Dining Discounts and Promotions listed are subject to the applicable Dragonpass Participating Outlet’s terms and conditions. Dragonpass Participating Outlet’s reserve the right to amend the terms and conditions governing the Dining Discounts and Promotions at any time without prior notice.

7.3. Dining Vouchers and Set Meals

7.3.1. You are required to be physically present and present your boarding pass, together with your Eleva Beyond Membership, to enjoy this Service. The name displayed on the Eleva Beyond Membership will also need to correspond to the name displayed on the boarding pass in question. In the event that there is any discrepancy between the name displayed on the Eleva Beyond Membership and the boarding pass, you will not be entitled to enjoy the Service. For the avoidance of doubt, stand-by and crew tickets will not constitute valid boarding passes and will not entitle you to enjoy this Service.

7.3.2. The redemption page must be verified by the Dragonpass Participating Outlet staff in order to redeem and use the Dining Voucher or Set Meal.

7.3.3. Dining Vouchers and Set Meals may only be used at Dragonpass Participating Outlets within the Dragonpass network. The list of Dragonpass Participating Outlets available will at all times be displayed in the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution (as applicable).

7.3.4. Dragonpass and its Dragonpass Participating Outlets reserve the right to replace the Dining Voucher and/or Set Meal (with an item of similar value) if it is unavailable at the time of purchase/confirmation of order, where applicable, without prior notice to you.

7.3.5. It is advisable to check and confirm with the Dragonpass Participating Outlet prior to redeeming any Dining Vouchers or Set Meals, and prior to ordering.

7.3.6. No refund, cashback or credit will be offered in the event that the Dining Voucher is applied to a bill, and there is an outstanding sum remaining on the Voucher.

7.3.7. All Vouchers and Set Meals are not exchangeable for cash, credit or other goods and services, and are non-transferable.

7.3.8. Vouchers may be redeemed at Dragonpass Participating Outlets, subject to their prevailing terms and conditions and certain local restrictions such as taxes, tips and alcohol (as may be applicable).

7.3.9. Any cancellations post-transaction shall be at the sole discretion of the Dragonpass Participating Outlet in question.

7.3.10. All Dining Vouchers and Set Meals listed are at all times subject to the applicable Dragonpass Participating Outlet’s terms and conditions. Participating Merchant Outlets reserve the right to amend the terms and conditions governing the Dining Vouchers and Set Meals at any time without prior notice.

7.4. e-SIM

7.4.1. While the e-SIM Service is purchased from and provided by Dragonpass, it is supplied by a third-party provider, eSIM Go Limited.

7.4.2. Eligible Eleva Beyond Members will be able to access this Service and search for, purchase, and top-up their e-SIM balance in the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution (as applicable).

7.4.3. The Service is provided entirely at Dragonpass’ discretion and only selected Eleva Beyond Members are eligible for the Service.

7.4.4. Dragonpass reserves the right not to provide the Service to any Eleva Beyond Members who fail to meet the eligibility requirements.

7.4.5. Eleva Beyond Members have the option to purchase the e-SIM Service through the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution on a pay-as-you-go (“PAYG”) basis, including top-ups.

7.4.6. All applicable prices will be reflected on the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution, and Dragonpass reserves the right to amend the applicable prices from time to time in its sole discretion without notice.

7.4.7. Eleva Beyond Members are entitled to unlimited purchases of the e-SIM Service and all purchased e-SIM data plans are valid for a period of 1 (one) year from the date of purchase, after which it shall automatically expire.

7.4.8. The validity period mentioned above shall be applicable regardless of whether you use the purchased e-SIM data or not, and you shall under no circumstances be entitled to a refund for any unused e-SIM data.

7.4.9. Once purchased, a confirmation email will be sent to the email address provided at the time of purchase, and a corresponding SMS notification will also be sent to the cell phone number provided at the time of purchase.

7.4.10. By agreeing to these Terms and Conditions, you agree to provide Dragonpass with the right to send the above emails to the email address provided at the time of purchase, as well as a corresponding SMS notification to the cell phone number provided at the time of purchase. This is a condition of use of the Service.

7.4.11. Once confirmation of payment has been received, you will be entitled to use the Service.

7.4.12. The Service is supplied by eSIM Go Limited. You acknowledge that while Dragonpass provides access to the Service, we are in no way responsible for the management and supply thereof and therefore Dragonpass will in no way be liable for any damages and/or losses suffered by you through the use of, or in connection with, the use of the Services. In addition to the above, Dragonpass also does not warrant as to the performance and capabilities of the Service.

7.4.13. Dragonpass uses multiple network providers with varying levels of connection and speeds. While we will endeavour to provide the best level of connectivity possible, this is ultimately out of our control and we cannot guarantee a specific download or upload speed when using the Service.

7.4.14. The Service is provided to you on a non-transferable, non-refundable, and non-changeable basis.

7.4.15. A purchase of the Service may be cancelled up to 48 (forty-eight) hours from the time of purchase, with a full refund. You will not be entitled to any refund whatsoever should you cancel a purchase of the Service more than 48 (forty-eight) hours after the time of purchase.

7.4.16. Should you choose to cancel the purchase of the Service within the 48 (forty-eight) hour period mentioned above, you will not be entitled to any refund whatsoever if you have used any of the e-SIM data provided under the purchased Service.

7.4.17. Eleva Beyond Members that have already installed the e-SIM will still be eligible for a refund upon cancellation, provided that they cancel the purchase of the Service within 48 (forty-eight) hours of the time of purchase and provided that no e-SIM data provided under the purchased Service has been used.

7.4.18. By using the Service, you agree to abide by the rules, policies, and terms and conditions of eSIM Go Limited as well as the standard Terms and Conditions of Dragonpass applicable to the Service.

7.4.19. You acknowledge that, as the Service is provided on a PAYG basis, you are solely responsible for all payments and charges in relation thereto. Dragonpass shall not be liable for any charges in relation to the Service.

7.4.20. You acknowledge that the Service is subject to availability.

7.4.21. You expressly accept and agree to all Terms and Conditions that are applicable to the e-SIM Service. These Terms and Conditions may be amended from time to time by Dragonpass in its sole discretion without any notice to you.

7.4.22. Dragonpass shall not be liable for or take part in any dispute that may arise between you and eSIM Go Limited in relation to the Service.

7.4.23. Dragonpass is not responsible for, nor does it provide a warranty as to, the goods and Services accessed and provided by eSIM Go Limited.

7.5. Fast Track

7.5.1. You can book your access to Dragonpass Participating Outlet Fast Track lanes via the Eleva Beyond App. Eleva Beyond Website, and related Dragonpass Technical Solution (if applicable). Prices may vary depending on the location of the Fast Track lane in question.

7.5.2. To check whether the Fast Track lane you intend to use can be booked in advance, Eleva Beyond Members are required to check the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution, where you will be able to search whether a booking is available at your desired time of access.

7.5.3. As part of the booking process, you will need to submit the following details:

a) the airport and departure terminal for the Service;

b) the date and time slot that you wish to use the Fast Track Service; and

c) the number, and name(s) of any additional guests (if applicable).

7.5.4. Please note that some Dragonpass Participating Outlets do not charge for children under a certain age. The applicable age requirements will be displayed in the text under the relevant Fast Track location. It is your responsibility to check this information before proceeding. Please take the time to read and check your order at each page of the booking process. You will then be asked to submit your payment information and confirm your order.

7.5.5. All Fast Track bookings are subject to availability and the Dragonpass Participating Outlets providing the Fast Track Service reserve the right to withdraw availability of the Service at their sole discretion for a given date or period. Dragonpass will however update the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution within a reasonable time to reflect any such changes accordingly, so please ensure that you check before travelling to ensure that your chosen Fast Track lane is still available to book in advance.

7.5.6. Payment must be made in advance and online. We reserve the right not to fulfil your booking if your card is declined for any reason whatsoever or if the payment card has been used, or is suspected to have been used, fraudulently.

7.5.7. The price you pay is the price accepted and confirmed to you during the online booking process. Pricing for all Fast Track Services will be in USD (US Dollars) and is subject to change. Pricing includes Value Added Tax (“VAT”) and all other applicable taxes. The booking is valid for a single passage through the Fast Track security lane for the date you have booked.

7.5.8. When you have completed your booking and have provided all the necessary details, you will be provided with an eticket which may include a QR code/barcode/access code or a message for the Dragonpass Participating Outlet staff, that will be available via your online Eleva Beyond Membership. We will also send you an email confirmation of your booking. You can also print the confirmation and use that for access if that is more convenient for you. 

7.5.9. For Fast Track access, please scan your barcode at the egate screen to access the lane, or alternatively show your booking on the eticket/QR code or confirmation email to a member of staff at the security gate. Some airports may require you to provide your boarding pass and Fast Track confirmation to a member of staff at the security access gates in order to use the Service. For the avoidance of doubt, stand-by and crew tickets will not constitute valid boarding passes and will not entitle you to enjoy this Service.

7.5.10. Your Fast Track security lane access is valid for 1 (one) use only and is only valid on the date and time of travel that you selected when making your booking. For Fast Track access, you must make a booking for each guest that you are travelling with, unless they are a child who meets the criteria for free entry, as the number of persons you make a booking for will be reflected in your booking, etickets/QR code and confirmation email. The Dragonpass Participating Outlets will not be able to permit access to any additional persons on the day.

7.5.11. If an amendment to your booking is required, you must cancel the existing booking and create a new booking.

7.5.12. Cancellations are subject to the terms and conditions of the Dragonpass Participating Outlet and your booking. We reserve the right, if prevented from supplying the Fast Track Service for any reason, to cancel the booking. We will attempt to provide as much notice as is reasonably possible in such instances. Where it is not reasonably possible, we will cancel the booking and refund the payment received in respect of the booking to the card used for payment, but will not be responsible for any other costs (including, without limitation, any card transactional fees or currency conversion losses), which you may incur as a result thereof.

7.5.13. Where cancellations are permitted, a refund will be automatically issued, with the payment being returned to your account. Refunds of bookings will be processed within 10 (ten) working days and will be issued to the payment card used for the booking.

7.5.14. If you don’t attend the Fast Track lane or are refused access because you have arrived later than your booked time, or you cancel your pre-booking less than 72 (seventy-two) hours in advance of your scheduled visit, you will not receive a refund of your booking fee and you will be deemed to have used your booking.

7.5.15. The Fast Track Service allows you entry to a separate channel into the security screening area. Once you have proceeded through the Fast Track lane and entered the security search area, you are subject to the same rigorous security checks that all passengers must undertake. The same restrictions apply to items prohibited in your hand luggage and on the size and type of liquids you are allowed to carry.

7.5.16. Neither the Dragonpass Participating Outlets, nor Dragonpass, guarantee the availability of the Fast Track Service or a maximum or minimum queue length or time, or that the Fast Track queue time will be less than the standard lanes. Regardless of whether you purchase the Fast Track Service or not, all passengers are subject to the same security procedures and regulations, and we therefore recommend that you allow enough time for the standard security and x-ray screening.

7.5.17. The Dragonpass Participating Outlets and their servants and agents reserve the right to refuse admittance to the Fast Track security lane (as applicable) in their sole discretion.

7.5.18. All personal data that is collected as part of the booking process is used in accordance with our Privacy Notice.

7.6. Fitness

7.6.1. Fitness Services are provided to Eleva Beyond Members via third-party providers including, without limitation, Pindor Group Limited trading as “Boddy”, with registration number CHE-234.516.076 and registered address situated at c/o Home of Coworking GmbH, at Tessinerplatz 7 in CH-8002 Zurich, Switzerland. Dragonpass reserves the right to add or remove additional third-party providers from time to time without notice.

7.6.2. You can book your access to Dragonpass Participating Outlets available to Eleva Beyond Members via the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution. Prices may vary depending on the location of the Dragonpass Participating Outlet in question.

7.6.3. Eleva Beyond Members can use their entitlements, if available, to access Fitness Services, including but not limited to gym classes and single-use day passes. Alternatively, you can access such Services on a PAYG basis. Single-use day passes may only be used once on the booking date and time chosen by you.

7.6.4. In order to use the Service, you will be required to use the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution (as applicable) to check in at the relevant Dragonpass Participating Outlet. You are therefore required to bring your cellular phone or mobile device with you to the Dragonpass Participating Outlet, and you will need to connect to the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution using either WiFi or mobile data. In the event that you are unable to connect to the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution, the Dragonpass Participating Outlet may refuse your entry and use of the Service.

7.6.5. Some Dragonpass Participating Outlets do not provide instant booking confirmation. In such instances, you will receive an acceptance or rejection of your booking within 6 (six) hours of making the booking.

7.6.6. You are entitled to cancel a Fitness Service up to 2 (two) hours prior to the scheduled use of the Service and/or scheduled time of a fitness class in order to be eligible for a refund. Should you fail to cancel the Service at least 2 (two) hours prior to the scheduled use thereof, you will not be entitled to cancel or reschedule that Service and will not be entitled to a refund.

7.6.7. For gym single-use day passes, you are entitled to cancel the Service any time before the closing time on the date on which the Service has been booked in order to be eligible for a refund. If you fail to cancel the Service and do not arrive on the scheduled date, you will be charged for the Service and will not be entitled to a refund.

7.6.8. If an amendment to your booking is required, you must cancel the existing booking and create a new booking.

7.6.9. In the event that you qualify for a refund, entitlement refunds will reflect on your Eleva Beyond Membership immediately whereas PAYG refunds can take up to 30 (thirty) days to reflect.

7.6.10. You acknowledge that participation in gym activities and the use of gym equipment involves a certain level of risk, including the possibility of personal injury or death, and voluntarily assume all risks associated with your participation in the Service and release Dragonpass and the Dragonpass Participating Outlets from any and all liability, claims, demands, or actions arising from any injury and/or death sustained by you while using the Services.

7.6.11. All bookings for the Service must be made in the name of the registered Eleva Beyond Member. No person may use the Service other than the registered Eleva Beyond Member and no guests may accompany the Eleva Beyond Member at this time, although this may be subject to change in the future.

7.6.12. For any questions, complaints or concerns, you will be required to contact the relevant Dragonpass Participating Outlet directly.

7.6.13. Fitness Services are only available in select cities and countries.

7.6.14. All Dragonpass Participating Outlet dates and times shown in the Eleva Beyond App, Eleva Beyond Website, and related Dragonpass Technical Solution are in the time zone of the country in which that Dragonpass Participating Outlet is situated and not the time zone in which the Eleva Beyond Member is situated. This should be considered when making your booking.

7.6.15. You expressly accept and agree to all Terms and Conditions that are applicable to the Fitness Service, including the terms and conditions of Boddy. These Terms and Conditions may be amended from time to time by Dragonpass in its sole discretion without any notice to you.

7.7. Flight Booking

7.7.1. Flight Booking Services are provided to Eleva Beyond Members via our third-party partner, Travelfusion Asia Pte Limited (“Travelfusion”).

7.7.2. Eleva Beyond Members may search for and book their flights via the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution.

7.7.3. Dragonpass acts solely as the facilitator in making the Flight Booking Service available to Eleva Beyond Members and does not own, operate, sell, or provide the flights themselves.

7.7.4. All Flight Bookings are fulfilled by Travelfusion and are subject to availability, applicable laws and regulations, and the terms and conditions of Travelfusion and the relevant airline(s).

7.7.5. A booking request submitted through the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution constitutes a request for Travelfusion to arrange the selected travel itinerary and does not constitute confirmation of a booking.

7.7.6. A booking shall only be deemed confirmed once:

a) Travelfusion has successfully issued the applicable airline ticket(s);

b) Payment has been successfully processed; and

c) The Eleva Beyond Member has received a booking confirmation and ticket details.

7.7.7. Flight availability and pricing are dynamic and may change at any time prior to ticket issuance. Eleva Beyond and Travelfusion reserve the right to amend or cancel any unconfirmed booking request where fares, taxes, carrier surcharges, or availability have changed.

7.7.8. Flight prices displayed within the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution are indicative only until the booking has been confirmed.

7.7.9. The total amount payable may include airfare, taxes, airport charges, carrier-imposed surcharges, service fees, and any other applicable charges.

7.7.10. Unless otherwise stated, all payments are processed by or on behalf of Travelfusion using the payment methods made available through the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution.

7.7.11. Each Flight Booking is subject to the applicable airline’s terms and conditions including, but not limited to, its conditions of carriage, fare rules, baggage policies, check-in requirements, and any other applicable terms.

7.7.12. Eleva Beyond Members are solely responsible for reviewing and complying with the applicable airline terms and conditions and requirements, including but not limited to, passport validity, visas, health requirements, baggage restrictions, and check-in deadlines.

7.7.13. Failure to comply with the airline’s terms and conditions or requirements may result in denied boarding, cancellation of travel, or additional charges, for which neither Dragonpass nor Travelfusion shall be liable.

7.7.14. Requests to amend or cancel a booking shall be subject to:

a) The applicable airline terms and conditions and rules;

b) Travelfusion’s terms and conditions and policies; and

c) Any applicable administrative or service fees that may be payable.

7.7.15. Certain fares may be non-refundable, non-transferable, or non-changeable.

7.7.16. Any refunds shall be processed in accordance with the applicable airline’s refund policy and may be subject to deductions for cancellation penalties, service fees, and other applicable charges.

7.7.17. Airlines are solely responsible for flight schedules, delays, cancellations, route changes, and operational decisions.

7.7.18. Dragonpass shall not be responsible for any losses, damages, or expenses arising from airline schedule changes, delays, cancellations, overbooking, missed connections, or operational disruptions.

7.7.19. Dragonpass is under no obligation to resolve airline-related disputes or provide compensation to Eleva Beyond Members or their travel companions.

7.7.20. By using the Flight Booking Service, you warrant that all passenger information provided during the booking process is complete, accurate, and matches the relevant travel documentation.

7.7.21. Eleva Beyond Members are responsible for ensuring that all passengers possess valid passports, visas, and any other documentation required for travel.

7.7.22. Dragonpass shall not be liable for any losses arising from inaccurate passenger information or insufficient travel documentation.

7.7.23. The Flight Booking Service is provided through Travelfusion and involves services supplied by independent third parties, including airlines, airports, and payment service providers.

7.7.24. Dragonpass does not control, and shall not be responsible for, the acts, omissions, or performance of any third-party service provider. To the fullest extent permitted by applicable law, Dragonpass excludes all liability arising from the provision of travel services by third parties.

7.7.25. To the maximum extent permitted by applicable law, Dragonpass’s role is limited to providing access to the Flight Booking functionality within the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution. As such, Dragonpass shall not be liable for:

a) Flight delays, cancellations, or schedule changes;

b) Denied boarding;

c) Airline insolvency;

d) Baggage loss or damage;

e) Travel disruptions;

f) Visa or immigration issues;

g) Force Majeure events; or

h) Any indirect, incidental, consequential, or special damages arising from or relating to a Flight Booking.

7.7.26. Eleva Beyond Members are strongly encouraged to obtain comprehensive travel insurance covering cancellations, medical emergencies, baggage loss, and travel disruption.

7.7.27. By making a Flight Booking through the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution, you acknowledge that you have read, understood, and agree to:

a) These Terms and Conditions;

b) The applicable terms and conditions of Travelfusion; and

c) The applicable airline’s terms and conditions, conditions of carriage, and fare rules.

7.8. Hotel Booking

7.8.1. Hotel Booking Services are provided to Eleva Beyond Members via our third-party partner, Agoda Company Pte Limited (“Agoda”).

7.8.2. Eleva Beyond Members may search for and book their visits to hotels and other accommodation via the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution.

7.8.3. Dragonpass acts solely as a facilitator in making the Hotel Booking Service available to Eleva Beyond Members, and does not own, operate, or manage the hotels themselves.

7.8.4. All Hotel Bookings are fulfilled by Agoda and are subject to availability, applicable laws and regulations, and the terms and conditions of the relevant hotel, accommodation provider, and any other applicable service providers.

7.8.5. A booking request submitted through the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution constitutes a request for Dragonpass to arrange the selected accommodation and does not constitute confirmation of a booking.

7.8.6. A booking shall only be deemed confirmed once:

a) Agoda has confirmed the reservation;

b) Payment has been successfully processed; and

c) The Eleva Beyond Member has received a booking confirmation.

7.8.7. Room availability and pricing are dynamic and may change at any time prior to confirmation. Dragonpass and Agoda reserve the right to amend or cancel any unconfirmed booking request where rates, taxes, fees, or availability have changed.

7.8.8. Accommodation rates displayed within the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution are indicative only until the booking has been confirmed.

7.8.9. The total amount payable may include, but is not limited to, room charges, taxes, resort fees, destination fees, service charges, and any other applicable charges imposed by the hotel / accommodation provider or applicable authorities.

7.8.10. Unless otherwise stated, all payments are processed by or on behalf of Agoda using the payment methods made available through the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution.

7.8.11. Certain hotels / accommodation providers may require Eleva Beyond Members to present a valid credit card upon check-in for security deposits, incidental charges, or damage deposits. Such amounts are determined solely by the hotel / accommodation provider in question and are independent of Dragonpass or Agoda.

7.8.12. Each Hotel Booking is subject to the applicable hotel / accommodation provider’s terms and conditions, including but not limited to its cancellation policy, check-in and check-out times, occupancy limits, age restrictions, pet policies, smoking policies, and any other applicable house rules.

7.8.13. Eleva Beyond Members are responsible for reviewing and complying with all applicable hotel / accommodation provider requirements.

7.8.14. Failure to comply with the hotel / accommodation provider’s terms and conditions or policies may result in refusal of check-in, cancellation of the reservation, or additional charges, for which neither Dragonpass nor Agoda shall be responsible.

7.8.15. Requests to amend or cancel a Hotel Booking shall be subject to:

a) The applicable hotel / accommodation provider’s terms and conditions and cancellation policy;

b) The terms and conditions and policies of Agoda; and

c) Any applicable administrative or service fees.

7.8.16. Certain bookings may be non-refundable, non-transferable, or non-amendable.

7.8.17. Any refunds shall be processed in accordance with the applicable hotel / accommodation provider’s refund policy, and may be subject to deductions for cancellation penalties, no-show charges, service fees, and other applicable charges.

7.8.18. Hotels / accommodation providers are solely responsible for the availability, condition, quality, and provision of the hotel / accommodation and related services.

7.8.19. Dragonpass shall not be responsible for overbookings, maintenance issues, closures, changes to facilities, renovations, inaccurate property descriptions, or any other operational matters relating to the hotel / accommodation.

7.8.20. Dragonpass is under no obligation to resolve hotel or accommodation-related disputes or provide compensation to Eleva Beyond Members or their travel companions.

7.8.21. Eleva Beyond Members warrant that all information provided during the Hotel Booking process is complete and accurate.

7.8.22. Eleva Beyond Members are responsible for ensuring that all guests comply with the hotel / accommodation provider’s terms and conditions, policies, and applicable laws during their stay.

7.8.23. Eleva Beyond Members shall be responsible for any additional charges incurred during their stay, including incidental expenses, minibar charges, room service, parking, damages, resort fees, or other charges imposed by the hotel / accommodation provider.

7.8.24. The Hotel Booking Service is provided through Agoda and involves services supplied by independent third parties, including but not limited to hotels and accommodation providers, payment service providers, and other travel service providers.

7.8.25. Dragonpass does not control and shall not be responsible for the acts, omissions, or performance of any third-party service provider. To the fullest extent permitted by applicable law, Dragonpass excludes all liability arising from the provision of hotel, accommodation, or related services by third parties.

7.8.26. To the maximum extent permitted by applicable law, Dragonpass’s role is limited to providing access to the Hotel Booking functionality within the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution. Dragonpass shall not be liable for:

a) Overbookings;

b) Refusal of check-in;

c) Accommodation closures;

d) Changes to hotel / accommodation facilities or amenities;

e) Inaccurate property descriptions or photographs supplied by third parties;

f) Loss, theft, or damage to personal property;

g) Personal injury occurring at the hotel / accommodation;

h) Force Majeure events; or

i) Any indirect, incidental, consequential, or special damages arising from or relating to a Hotel Booking.

7.8.27. Any special requests, including but not limited to requests for early check-in, late check-out, accessible rooms, adjoining rooms, bedding preferences, or other room preferences, are submitted to the hotel / accommodation provider on a request basis only and are not guaranteed unless expressly confirmed by the hotel / accommodation provider.

7.8.28. Eleva Beyond Members are responsible for ensuring that they possess all documentation required for travel to and from the hotel / accommodation, including but not limited to passports, visas, and any other entry requirements applicable to their destination.

7.8.29. By making a Hotel Booking through the Eleva Beyond App, Eleva Beyond Website, or Dragonpass Technical Solution, you acknowledge that you have read, understood, and agreed to:

a) These Terms and Conditions;

b) The applicable terms and conditions of Agoda; and

c) The applicable terms and conditions of the relevant hotel / accommodation provider.

7.9. Limousine

7.9.1. All Limousine Services are required to be reserved at least 48 (forty-eight) hours in advance of the scheduled service time via the Eleva Beyond App, Eleva Beyond Website, and related Dragonpass Technical Solution.

7.9.2. You can reserve Limousine Services on behalf of others who may or may not be an Eleva Beyond Member.

7.9.3. There may be a 20% (twenty per cent) surcharge for all Limousine Services booked between the hours of 21h00 to 08h00.

7.9.4. Cancellations may be done via the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution.

7.9.5. Any cancellation or changes to the Limousine Service must be done at least 24 (twenty-four) hours in advance of the scheduled Service time in order to be eligible for a refund.

7.9.6. Refunds for any validly cancelled Limousine Service reservations will be issued to the payment card used to purchase the Service and may take between 7 (seven) and 14 (fourteen) business days to be processed.

7.9.7. No additional pick-up and/or drop-off points are allowed for all Limousine Services. Your booking will only cover the address and airport you selected when making your booking. Any requests to add an additional stop will be denied.

7.9.8. Eleva Beyond Members are required to ensure that you enter the correct number of passengers and luggage when making a booking, as this will determine the car size. Any additional persons and/or luggage may not be permitted into the vehicle.

7.9.9. The waiting times for the Limousine Service are set out below:

a) Pick-up from Airport: Your driver will wait at the arrivals hall for 60 (sixty) minutes from the scheduled pick-up time. If you fail to meet the driver within the 60 (sixty) minute waiting time, the Limousine Service will be cancelled, and no refund will be given.

b) Drop-off at Airport: Your driver will wait at your specified address for 15 (fifteen) minutes from the scheduled pick-up time. If you fail to meet the driver within the 15 (fifteen) minute waiting time, the Limousine Service will be cancelled, and no refund will be given.

7.10. Extra mileage charges, baby seats, holiday surcharges and/or special event prices may be applicable to the Service and will vary from location to location.

7.11. Dragonpass is not responsible for any passengers arriving late to the airport which results in such passenger being denied check-in or boarding of the aircraft.

7.12. Dragonpass will not be liable for any items left in vehicles, traffic delays, mechanical problems, weather, etc., or any events outside of its reasonable control. The Eleva Beyond Member utilizing the Limousine Service is fully responsible for taking care of his/her belongings when using the Service.

7.13. No smoking, storing and/or consuming of illegal drugs, is allowed in Limousine vehicles at any time whatsoever. Should you fail to comply with the above, you shall be fully liable for any legal sanctions imposed by applicable law, as well as any fines, penalties, damages, losses and/or costs that may be suffered by the Limousine driver and/or Dragonpass due to your breach of the foregoing.

7.14. The driver of the Limousine is responsible for the safety of the vehicle, and compliance with all applicable laws, regulations, and guidelines (including, but not limited to, road safety requirements). If the Eleva Beyond Member’s (or his/her guests’ or companions’) conduct is potentially in breach of any laws and/or statutory regulations, or causes any potential safety issues, or may potentially cause damage to the vehicle, the Limousine driver shall be fully authorised to remove the Eleva Beyond Member (and his/her guests’ or companions’) from the vehicle immediately, and no refund will be provided. The Eleva Beyond Member will be fully liable for any damage caused to the vehicle, any damage caused to any third party’s vehicles and/or other property, as well as any injuries suffered by the driver and/or any other third parties, due to the Eleva Beyond Member’s (or his/her guests’ or companions’) conduct.

7.15. Dragonpass reserves the rights to adjust the mileage and price in relation to the Service, remove locations and/or add new locations to the list of Dragonpass Participating Outlets from time to time in its sole discretion without any prior notice.

7.15.1. You expressly accept and agree to all Terms and Conditions that are applicable to the Service and acknowledge that such terms and conditions may be amended from time to time by Dragonpass in its sole discretion without any notice.

7.16. Lounge

7.16.1. You are required to be physically present and present your boarding pass, together with your Eleva Beyond Membership, to enjoy this Service. The name displayed on the Eleva Beyond Membership will also need to correspond to the name displayed on the boarding pass in question. In the event that there is any discrepancy between the name displayed on the Eleva Beyond Membership and the boarding pass, you will not be entitled to enjoy the Service. For the avoidance of doubt, stand-by and crew tickets will not constitute valid boarding passes and will not entitle you to enjoy this Service.

7.16.2. An updated list of Dragonpass Participating Outlets is available on the Eleva Beyond App, Eleva Beyond Website, and related Dragonpass Technical Solution (as applicable).

7.16.3. All free Lounge visits provided under your Eleva Beyond Membership will be valid until your Eleva Beyond Membership has expired or as stated otherwise.

7.16.4. All purchased Lounge visits may be used until the Eleva Beyond Membership is expired.

7.16.5. All purchased single-use Lounge access passes shall be valid for 90 (ninety) days from the date of purchase.

7.16.6. All purchased single-use Lounge access passes purchased from the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution are non-refundable. 

7.16.7. Your guests are required to be on the same flight as the Eleva Beyond Member to enjoy Lounge access using the same Eleva Beyond Membership.

7.16.8. Dragonpass may amend the Lounge visit charges from time to time in its sole discretion and the latest charges listed on the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution (as applicable) shall at all times prevail.

7.16.9. Lounge maximum stay time varies from Lounge to Lounge. Once the stay period (usually 2 [two] hours) has lapsed, you will be required to re-register your entry (subject to availability) at the Lounge reception. It is your responsibility to check the maximum stay time and relevant terms and conditions applicable to a specific Lounge before entering.

7.16.10. Availability of Lounge Services is subject to the capacity of the Dragonpass Participating Outlets and Lounges may not be available in the event of high traffic caused by flight or train delays or other reasons outside the reasonable control of Dragonpass.

7.16.11. Dragonpass will not be liable for any items left in the Lounge, or losses caused or incurred by missing of flights or flight delay due to the use of Lounge Services.

7.16.12. You may request to cancel any reserved Lounge Service by calling our customer hotline, alternatively your Provider’s staff will be assigned to assist you.

7.16.13. Dragonpass Participating Outlet staff will record your details and communicate them to Dragonpass. This information will be used for record keeping, tracking usage and billing purposes, where appropriate.

7.16.14. Please note that any food and/or drinks, including alcoholic drinks (if any), provided as part of the Lounge Service are only for consumption in the Lounge in question and are not to be taken outside of that Lounge. The selection of food and drinks is provided in the sole discretion of the applicable Dragonpass Participating Outlet and we therefore recommend that you contact the Dragonpass Participating Outlet in question in advance of your travel if you or any member of your party has any dietary requirements.

7.16.15. The facilities and amenities of the Lounges will vary, and at certain times may be limited. Dragonpass has no responsibility for and is not able to control or dictate the provision of facilities and amenities within individual Lounges. If you require more information in this regard, please refer to the terms and conditions set by each individual Dragonpass Participating Outlet.

7.16.16. Dragonpass Participating Outlets may be added or removed at any time without notice. The latest list of Dragonpass Participating Outlets is displayed on the Eleva Beyond App, Eleva Beyond Website, and related Dragonpass Technical Solution (as applicable).

7.16.17. You expressly accept and agree to all Terms and Conditions that are applicable to the Service and acknowledge that such terms and conditions may be amended from time to time by Dragonpass in its sole discretion without any notice.

7.16.18. Lounge Pre-Booking:

a) You may elect to pre-book access to certain participating Lounges by using the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution. Should you choose to do so, you can either pay for each visit or use a complimentary Lounge visit (if applicable) plus a pre-booking fee for each person you book for, including yourself.

b) Pre-booking is only valid at selected Dragonpass Participating Outlets.

c) Pre-bookings must be made by the relevant Eleva Beyond Member, and such Eleva Beyond Member needs to be in attendance in order for the pre-booking to be fulfilled.

d) A Lounge will not be obligated to fulfil any pre-booking in the absence of the Eleva Beyond Member in whose name the pre-booking was made.

e) Once a pre-booking has been made, you will receive a confirmation email with your reservation details.

f) Eleva Beyond Members may not resell or transfer any booking (in whole or in part) to any third party.

g) You may pre-book up to 5 (five) guests, including yourself. Children who are subject to free entry at the Lounge do not need to be included in the pre-booking.

h) The pre-booking is valid for a single Lounge entry at the specific Dragonpass Participating Outlet selected during the pre-booking process.

i) All pre-bookings and cancellations must be made at a minimum of 48 (forty-eight) hours in advance of your scheduled arrival date and time in order to qualify for a refund. If you cancel your Lounge Service less than 48 (forty-eight) hours in advance of your scheduled arrival date and time, you will not be eligible for a refund for any part of the booking. Pre-bookings cannot be changed or amended once made. If you need to change your pre-booking, please cancel and make a new pre-booking.

j) If the Eleva Beyond Member arrives earlier than their pre-booked time, the Lounge may refuse entry until your scheduled time on the pre-booking. If you are late for your pre-booking, the Lounge will allow you entry to the Lounge for up to 1 (one) hour after the pre-booking time. In the event of a no-show, you will not be eligible for a refund for any part of the booking. If your flight is delayed or for whatever reason you wish to remain in the Lounge, you may be able to stay in the Lounge, subject to availability. The Lounge is within its right to ask for additional payment for an extended stay for you and all persons in your group.

k) Pre-bookings are subject to the opening dates, times and availability of the Dragonpass Participating Outlets.

l) Pre-booking availability and fulfilment is subject to the standard terms and conditions applicable to Lounges as set out in these Terms and Conditions, as well as the Dragonpass Terms of Use and Privacy Notice.

m) Dragonpass will not be held liable for any non-fulfilment of any pre-booking that does not comply with these Terms and Conditions, or the above-mentioned Terms of Use or Privacy Notice.

n) Dragonpass will not be liable for any events which may cause you to be delayed for your booked date and time including, but not limited to, cancelled flights, traffic delays, and/or weather.

7.17. Multi-purpose Vouchers

7.17.1. Multi-purpose Vouchers (“MPV”) is a product designed to offer eligible Eleva Beyond Members greater flexibility by allowing them to redeem Lounge entitlements at selected Dining and Retail locations.

7.17.2. Eleva Beyond Members eligible for the MPV Service are entitled to exchange their Lounge entitlement for a Dining or Retail Voucher, which can be used at selected Dragonpass Participating Outlets.

7.17.3. If MPV offers are available, they will appear on the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution (as applicable).

7.17.4. Eleva Beyond Members will be able to view the details of the available MPVs on the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution, including the value and currency thereof.

7.17.5. Once an Eleva Beyond Member selects the MPV offer that you would like to redeem, you will be provided with a QR code that will enable you to redeem the MPV at the applicable Dragonpass Participating Outlet.

7.17.6. Once an MPV has been redeemed, you will not be entitled to redeem another MPV for 2 (two) hours from the time of redemption.

7.17.7. The MPV Service is subject to availability and is only available to eligible Eleva Beyond Members at selected Dining and Retail locations.

7.17.8. In addition to the above, all standard Terms and Conditions applicable to Dining and Retail Services shall be applicable, as contained herein.

7.18. Retail Discounts and Promotions

7.18.1. All Retail Discounts and Promotions are open to all Eleva Beyond Members unless otherwise stated.

7.18.2. To enjoy the Retail Discounts and Promotions, you are required to present your digital Dragonpass redemption page. A list of Dragonpass Participating Outlets is at all times available on the Eleva Beyond App, Eleva Beyond Website or related Dragonpass Technical Solution (as applicable).

7.18.3. All Retail Discounts and Promotions are subject to availability and a while-stocks-last basis.

7.18.4. All Retail Discounts and Promotions listed may be subject to prevailing government taxes and service charges, where applicable.

7.18.5. All Retail Discounts and Promotions are not exchangeable for cash, credit or other goods and services and are non-transferable.

7.18.6. You are required to present your digital Dragonpass redemption page prior to ordering or payment for the Service.

7.18.7. All complimentary gifts or items (if any) are provided on a while-stocks-last basis and are not refundable or exchangeable for cash, credit or other items of any kind and are not transferable.

7.18.8. Dragonpass and its Dragonpass Participating Outlets reserve the right to replace any complimentary gift or item (with an item of similar value) if it is unavailable at the time of purchase/confirmation of order, where applicable, without prior notice to Eleva Beyond Members.

7.18.9. All Retail Discounts and Promotions listed are subject to the applicable Dragonpass Participating Outlet’s terms and conditions. Dragonpass Participating Outlet’s reserve the right to amend the terms and conditions governing the Retail Discounts and Promotions at any time without prior notice.

7.19. Retail Vouchers

7.19.1. You are required to be physically present and present your boarding pass, together with your Eleva Beyond Membership, to enjoy this Service. The name displayed on the Eleva Beyond Membership will also need to correspond to the name displayed on the boarding pass in question. In the event that there is any discrepancy between the name displayed on the Eleva Beyond Membership and the boarding pass, you will not be entitled to enjoy the Service. For the avoidance of doubt, stand-by and crew tickets will not constitute valid boarding passes and will not entitle you to enjoy this Service.

7.19.2. The redemption page must be verified by the Dragonpass Participating Outlet staff in order to redeem and use the Retail Voucher.

7.19.3. Retail Vouchers may only be used at Dragonpass Participating Outlets within the Dragonpass network. The list of Dragonpass Participating Outlets available will at all times be displayed in the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution (as applicable).

7.19.4. Dragonpass and its Dragonpass Participating Outlets reserve the right to replace the Retail Voucher (with an item of similar value) if it is unavailable at the time of purchase/confirmation of order, where applicable, without prior notice to you.

7.19.5. It is advisable to check and confirm with the Dragonpass Participating Outlet prior to redeeming any Retail Vouchers, and prior to ordering.

7.19.6. No refund, cashback or credit will be offered in the event that the Retail Voucher is applied to a bill, and there is an outstanding sum remaining on the Voucher.

7.19.7. All Vouchers are not exchangeable for cash, credit or other goods and services, and are non-transferable.

7.19.8. Vouchers may be redeemed at Dragonpass Participating Outlets, subject to their prevailing terms and conditions and certain local restrictions such as taxes, tips and alcohol (as may be applicable).

7.19.9. Any cancellations post-transaction shall be at the sole discretion of the Dragonpass Participating Outlet in question.

7.19.10. All Retail Vouchers listed are at all times subject to the applicable Dragonpass Participating Outlet’s terms and conditions. Participating Merchant Outlets reserve the right to amend the terms and conditions governing the Retail Vouchers at any time without prior notice.

8. Dragonpass Right to Amend

8.1. Dragonpass reserves the right to amend these Terms and Conditions from time to time in its sole discretion without any notice to you. The updated Terms and Conditions will be uploaded on the Eleva Beyond App, Eleva Beyond Website, and related Dragonpass Technical Solution, and it is your responsibility to check them regularly to ensure that you agree to comply with them.

8.2. If you do not agree with these Terms and Conditions, you may stop using Eleva Beyond and our Services at any time. Once you continue to use Eleva Beyond and any of our Services, it is implied that you have agreed with all the Terms and Conditions contained herein.

9. Liability for Breach of Contract

9.1. By agreeing to these Terms and Conditions, you have agreed to safeguard the interests of Dragonpass and other Eleva Beyond Members. If you are found to be in breach of any law, rules or these Terms and Conditions that causes damage or loss to Dragonpass or any third party in any way, you will be solely liable for all damages and/or losses incurred.

9.2. If you suffer any loss due to a service disruption caused by the negligence and/or wilful misconduct of Dragonpass, Dragonpass will only be liable for any direct loss caused by said service disruption, subject to the limitation of liability as set forth in Section 10 below.

10. Limitation of Liability

10.1. In no event will Dragonpass be liable for any direct, indirect, special, punitive, exemplary, or consequential losses or damages of whatsoever kind arising out of your use of or access to Eleva Beyond or our Services, including loss of profit or the like whether or not in the contemplation of the parties or whether based on breach of contract, tort (including negligence), product liability, or otherwise.

10.2. The entire liability of Dragonpass in aggregate and your exclusive remedy with respect to Eleva Beyond, the Services, associated products, facilities or otherwise, shall be re-performance of defective Services. In jurisdictions which do not allow the exclusion or limitation of certain types of liability, our liability will be limited to the maximum extent permitted by law. We do not endorse, warrant or guarantee any material, product or service offered through us or our Services. We are not and will not be a party to any transaction between you and any third party (including without limitation between you and a Dragonpass Participating Outlet as our Services simply procure for you access to the Services but we do not provide or manage the Services themselves).

10.3. Without prejudice and subject to Clause 10.2 (which shall take precedence unless applicable law does not permit its application whether in whole or in part), under no circumstances howsoever arising related to Eleva Beyond, the Services or these Terms and Conditions, their performance or any omissions, shall the aggregate liability of Dragonpass exceed USD 100 (one hundred US Dollars).

10.4. For the avoidance of doubt, Dragonpass shall not be liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld devices, or mobile telephones, as a result of the installation or use of the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution.

10.5. Dragonpass does not accept liability for any failure by us to perform our obligations herein these Terms and Conditions due to force majeure or any event beyond our reasonable control. A non-exhaustive list of such events includes war or threat of war, riots, civil strife, terrorist threats or activity, industrial disputes, natural and/or nuclear disaster, fire, adverse weather conditions, government regulations, crown instruction, closure, or congestion of airports, and/or cancellation or changes of schedules by airlines or railway operators.

10.6. Nothing in these Terms and Conditions shall exclude or limit Dragonpass’ liability for death or personal injury caused by Dragonpass’ negligence, wilful misconduct, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under the applicable law.

11. Disputes

11.1. All disputes or feedback in relation to the goods and/or services of the Dragonpass Participating Outlets (such as quality, taste, etc.) should be directed to the relevant Dragonpass Participating Outlet and resolved directly between the Eleva Beyond Member and the Dragonpass Participating Outlet. Dragonpass shall not take any part in and shall have no responsibility in relation thereto.

11.2. For the avoidance of doubt, the Eleva Beyond Member’s entitlement to the Services as reflected in his/her Eleva Beyond Membership are correct, and as such, please do not raise any disputes with the Dragonpass Participating Outlets regarding your Eleva Beyond Membership entitlements as they will not be able to assist you in this regard.

11.3. Any disputes or complaints relating to matters falling within Dragonpass’s reasonable control must be raised with Dragonpass in writing within 90 (ninety) days of the event giving rise to such dispute or complaint, failing which Dragonpass will have no obligation to respond to or resolve such dispute or complaint.

12. Termination

12.1. Dragonpass may terminate the use of the Services at any time by giving notice of termination to you, whether via the Eleva Beyond App, Eleva Beyond Website, or related Dragonpass Technical Solution, or to your email.

12.2. Upon any termination:

12.2.1. The rights and licenses granted to you herein shall immediately terminate; and

12.2.2. You must cease all use of the Eleva Beyond App, Eleva Beyond Website and related Dragonpass Technical Solution, and any related software.

13. Governing Law and Jurisdiction

13.1. These Terms and Conditions shall be governed by the laws of England and Wales and accordingly you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
